Terms of Service

Effective April 5, 2026

1. Who These Terms Apply To

These Terms apply to all users of ChairIQ, including Salon Operators (businesses or individuals who create a ChairIQ account to manage salon operations), Stylists (individuals who access ChairIQ through a Salon account), and Clients (individuals who book appointments through a ChairIQ-powered salon booking page).

2. The ChairIQ Platform

ChairIQ provides salon operators with tools to:

  • Accept and manage client appointment bookings
  • Conduct hair consultation analysis using photo uploads and structured input
  • Generate texture-aware service time estimates
  • Collect client deposits and process payments via Stripe
  • Manage stylist schedules and availability
  • Process commission payouts to stylists via Stripe Connect
  • Send appointment confirmations, reminders, and receipts via SMS and email
  • Maintain client records and appointment history
  • Communicate with clients via two-way SMS inbox

ChairIQ is a business operations tool, not a consumer marketplace. Clients book within a specific salon's system — ChairIQ does not operate as a salon discovery or directory platform.

3. Accounts and Registration

Salon Operators

To use ChairIQ, Operators must create an account, provide accurate business information, and agree to these Terms. You are responsible for all activity under your account, including actions taken by stylists and staff you add.

Stylists

Stylists access ChairIQ through their salon's account. Your use is subject to these Terms and any additional policies established by your salon operator.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at support@chair-iq.com if you suspect unauthorized access.

4. Payments and Deposits

Client Deposits

Appointments are not confirmed until a deposit is collected. Deposit amounts are set by the salon operator. By completing the booking flow and providing payment information, you authorize ChairIQ to charge the deposit amount to your payment method.

Remaining Balance

The remaining balance for your service (total service price minus deposit) is collected at checkout upon completion of your appointment.

Payment Processing

All payments are processed by Stripe. By using ChairIQ's payment features, you agree to Stripe's Terms of Service. ChairIQ does not store raw payment card data.

Refunds

Refund policies are set by the individual salon operator. ChairIQ facilitates refunds at the operator's direction. Contact your salon directly for refund requests.

Stylist Payouts

Commission stylists receive payouts via Stripe Connect. Payout timing and amounts are determined by the salon operator and require admin approval before any transfer is executed. By connecting a Stripe account, you agree to Stripe's Connected Account Agreement.

5. Hair Consultation and AI Time Estimates

Photo Uploads

Clients may upload a photo of their hair as part of the booking consultation. Photo upload is optional — a manual profile entry option is always available. By uploading a photo, you grant ChairIQ and the applicable salon operator a limited license to use that photo for the purpose of generating a service time estimate and maintaining your client profile at that salon.

AI Estimates

Time estimates generated by ChairIQ's photo analysis are approximations based on visible hair characteristics. They are not guarantees of service duration. Actual service time may vary based on factors not visible in a photo or not captured in the consultation.

No Medical or Diagnostic Use

ChairIQ's hair analysis is for scheduling purposes only. It is not a diagnostic tool and makes no claims about hair health, condition, or treatment recommendations.

6. SMS Communications

Client Consent

By providing your phone number and completing a booking through ChairIQ, you consent to receive transactional SMS messages from ChairIQ on behalf of your salon, including booking confirmations, appointment reminders, checkout receipts, and follow-up messages (if enabled by your salon). Messages are sent via Twilio. Message and data rates may apply. To opt out: Reply STOP at any time. Reply HELP for assistance. Opting out does not cancel your appointment.

Operator Responsibilities

Salon operators are responsible for ensuring clients have consented to receive SMS communications before initiating contact. Operators may not use ChairIQ's messaging features to send unsolicited, deceptive, or non-appointment-related messages.

7. Operator Responsibilities

Salon operators agree to:

  • Provide accurate business and billing information
  • Use ChairIQ only for lawful salon operations
  • Ensure all stylists added to their account agree to these Terms
  • Set honest and transparent deposit and pricing policies visible to clients before booking
  • Comply with all applicable laws including employment law for stylist compensation
  • Not use ChairIQ to process payments for services not performed through the platform
  • Maintain the confidentiality of client data accessible through their ChairIQ account

8. Prohibited Uses

You may not use ChairIQ to:

  • Violate any applicable law or regulation
  • Collect payments for fraudulent or non-existent services
  • Harass or send unsolicited communications to clients or stylists
  • Reverse engineer or copy ChairIQ's proprietary systems
  • Circumvent platform security measures
  • Use ChairIQ's AI analysis for any purpose other than appointment scheduling

9. Intellectual Property

ChairIQ and all associated software, design, trademarks, and content are the property of Maria Newman LLC. Client hair photos remain the property of the client. Salon operators retain ownership of their business data. You grant ChairIQ a limited license to store and process this data to provide the Service.

10. Termination

Salon operators may cancel their ChairIQ account at any time by contacting support@chair-iq.com. Upon cancellation, your data will be retained for 90 days and then deleted, except where retention is required by law. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CHAIRIQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI TIME ESTIMATES WILL BE ACCURATE IN ALL CASES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAIRIQ'S LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO CHAIRIQ IN THE 12 MONTHS PRECEDING THE CLAIM. CHAIRIQ IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

14. Changes to These Terms

We may update these Terms from time to time. Salon operators will be notified of material changes via email. Continued use of ChairIQ after changes take effect constitutes acceptance of the updated Terms.
